you are very lucky it only took 15 weeks you have no chance of any compensation to be honest 15 weeks from damage to completion is very reasonable, I honestly think you may have a chance with 15 months but not as is.in any case the loss adjusters were at fault you admitted that in your question so if you had to claim of anyone it would be the loss adjusters.
YOU HAVE NOT GOT A CLAIM BELEIVE ME DONT WASTE YOUR TIME AND MONEY THE COURTS WOULD LAUGH AT SUCH A FRIVOLOUS CLAIM
If you’re talking about a bad faith claim and depending on how much money you’re still out, you might have a start. I would start creating a paper trail by sending the adjuster/carrier letters every 2 weeks asking them to resolve your claim, send someone out, requesting updates, etc. Start a calendar noting when the claim was filed and each contact you receive from the insurance company. If by the 6 month mark you still haven’t received contact from your insurance company or your claim still hasn’t been resolved, I would start talking to an attorney. But keep in mind that if it is a small claim, an attorney may not be interested.
The flipside is that if your insurance company has requested information from you and you have not provided it, then the ball is in your court. It’s not a delay on their part.
Your first point of call is to put in a letter of complaint against the insurance company outlining your experiences. Your policy/ IDD must have details of how to complain included.
They have to acknowledge the letter in 7 days and either give a holding reply or a final reply 28 days later.
If they give a holding reply then they must make a final reply within 28 days after that.
In the final letter they can either deny the claim, admit it in part or fully admit it. If the latter two then they may make you an offer of compensation.
If you do not agree to their response you can take matters to the Financial Ombudsman Service (details MUST be provided in the final letter you receive). This costs you nothing but it costs the insurance company about £350.00. They must agree to the FOS decision but you need not.
Sorry can’t see the connection between fireplace , your son and the fact it is summer ( OK still not fire weather). What how quickly did they respond It really depends on what your role was, did you met with the LA, have you asked why? Bear in mind over the past 2 months the country has been flooded – the priority would be those who have no home, lost every thing in the floods so that would demonstrate to you that a huge demand on the LA resource and also depending where you live any delays with the work. But did you suffer from no cooking facilities, washing facilities, no water and electricity. If no then compensation not really going to happen.
