    well it comes out there insurance and they can be sued if it not enough money for the injury that was caused.

    It is typically the insurance company that negotiates the settlement with your lawyer as long as the owner of the premises has the insurance. The reason its taking so long is the defense does not want to settle and believes that you were probably at fault. Even if not the case, they probably believe you are asking for too much money. They will continue to put it off so you will settle for less money. Don’t do it!
